TERMS & CONDITIONS FOR ENTRY AND PARTICIPATION

Client: Nestlé Ghana Ltd (the “Client”)
Territory: Ghana
1. INTRODUCTION
1.1. MAGGI Waakye Online Quiz is an online competition on social media (Facebook, and Instagram). This Competition will have online audience answering a set of questions on Facebook or Instagram.
1.2. Participation in the MAGGI Waakye Quiz (“Competition”) is governed by these Terms and Conditions (the “T&Cs”).
1.3. By participating in this Competition, each Participant fully and unconditionally agrees to these T&Cs.
1.4. Participants acknowledge that they have read and understood and shall comply with these T&Cs.
1.5. This Competition will run from 19 th December 2023 to 22nd December 2023.
1.6. The Agency reserves the right to extend this Competition period as it deems necessary or cancel, discontinue, or suspend the Competition as well as vary the Prize at its sole discretion with or without notice to the public.
1.7. These Terms and Conditions may be reviewed at any time without further recourse to the Participants. Any alteration or review of the Terms and Conditions or any development relating to the Competition shall be deemed to have been sufficiently communicated to the Participants by publishing such an update or review on MAGGI Ghana’s Facebook and Instagram pages. Therefore, Participants must check the MAGGI Ghana’s Facebook, or Instagram pages regularly for changes. Changes shall take effect from the date they are uploaded on MAGGI Ghana’s Facebook and Instagram page.
2. ELIGIBILITY
2.1 This Competition is open to residents and/or citizens of Ghana aged eighteen (18) years or over.
2.2 This Competition shall only apply in Ghana. Accordingly, participation is restricted to persons who are legally resident in Ghana only.
2.3 Employees of the Agency and Client and their immediate families (including spouses, parents, children, and siblings), business partners and associates, and all other suppliers and third parties directly involved in the facilitation of this Competition are NOT eligible to participate in this Competition.
2.4 The Agency reserves the right to disqualify a Participant who breaches the Terms and Conditions hereof or otherwise fraudulently accesses this Competition or unfairly influences the course of this Competition.
3. ENTRY
3.1 Entry to participate in this Competition is via answering questions on the MAGGI Ghana Instagram or Facebook pages.
3.2 Entry to participate is via Facebook or Instagram only.
3.3 Names: Participants must enter this Competition using their full legal name as stated on a valid National ID card. The Agency reserves the right to disqualify any Participant who uses multiple names or any false names or aliases, and any such winners may be required to return to the Agency, any Prize they may have won.
3.4 Retrospective Effect: Where a Participant or winner has not complied fully with the Terms and Conditions or has been found to be in breach of any of the Terms and Conditions of this Competition, particularly where a Participant is in breach of the entry restrictions, the Agency reserves the right to disqualify that Participant and require the return or reimbursement of any Prize even where the Prize has already been awarded and/or actually provided to the Participant or Prize winner in question.
3.5 Limits of Entries: Participants are permitted to enter this Competition only once with one (1) submission in the form of an answer on just one platform in this Competition. Participants who post more than one (1) answer on multiple platforms or post the same answer across multiple platforms in this Competition will be automatically disqualified.
3.6 Neither the Agency nor the Client shall be responsible for submissions not received for whatever reason.
4. COMPETITION MECHANICS
4.1 To participate in this Competition:
a. Participants are required to answer all quiz questions on MAGGI Ghana’s Facebook or Instagram pages. More than one (1) answer or multiple answers on the same or multiple platforms from a Participant will be disqualified automatically.
b. Participants must answer in the comment section of the quiz post on their platform of choice between MAGGI Ghana’s Facebook or Instagram only.
c. Twenty (20) Participants to answer correctly will be chosen at random as winners of a free meal coupon and entry ticket for the Waakye Festival subject to the terms and conditions herein stated.
4.2 The Agency reserves the right to immediately disqualify Participants whose answers are not accurate or contrary to the T&Cs of this Competition.
4.3 By taking part in this Competition:
a. Participants grant to the Agency and the Client the right, license and privilege to repost or reference an answer posted whether individually or collectively with any other material, in all forms of media or for any other lawful use as may be determined by the Agency and the Client in their sole and exclusive discretion.
b. Participants consent to the communication and publication of their names, likeness, image in all forms of media at any time in any territory.
c. The Agency and the Client shall not be liable for any unauthorized use, reproduction, adaptations, and publication of Participants’ images by third parties.
d. Participants release and indemnify the Agency and the Client from and against all actions, liabilities, penalties, claims or demands Participants may have against the Agency and the Client or that the Agency and the Client may incur for any loss, damage, claim or lawsuit which is or may be suffered or sustained as a direct or indirect result of participation in the Competition or winning or failing to win a prize.
4.4 Entries that are incomplete, not clear, or indecipherable will not be valid and will be deemed void. All decisions on entries are at the sole discretion of the Agency and /or the Client and are final. No liability will be accepted by the Agency and/or Client for any lost, damaged, misdirected, incorrect or late participation, or for any technical difficulties that may affect the submission of entries or result of the Competition.
4.5 The decision of the Agency and/or the Client concerning any aspect of this Competition will be final and binding on all Participants.
4.6 Under no circumstances shall Participants be required to send money, airtime, or any other form of consideration (monetary or otherwise) to participate in this Competition and/or claim Prizes. Any requirement of such nature is fraudulent. The Agency and/or Client shall not be held liable for the acts of such fraudsters.
4.7 The Agency and/or the Client shall not be liable for any failure or malfunction, or any other problem with any machine, telephone network or system, service provider, software or otherwise that may result in the inaccessibility of a Prize Winner, or a lost or unrecorded entry.
5. PRIZE
5.1. Prizes shall be awarded as follows:
5.1.1 Twenty (20) winners will be awarded with a free meal coupon and entry ticket for the Waakye festival (the “Prize”).
5.1.2 Prizes to be won are limited solely to Prize winners herein defined. No offer of any other prize and/or compensation shall be given to any Winner in any manner or for any reason whatsoever.
5.1.3 The award of Prizes shall be subject to Participants’ compliance with the T&Cs of this Competition.
5.1.4 The Prizes are only redeemable at the Waakye Festival on the 26 th of December 2023 in Ghana and are not exchangeable or transferable.
6. POTENTIAL PRIZE WINNER VALIDATION
6.1. A Potential Prize Winner is not an actual winner at the time of being contacted. Contact is made with a Potential Prize Winner for verification of identity and to ensure that all the T&Cs of this Competition have been complied with.
6.2. At the time that a Potential Prize Winner is identified, the Potential Prize Winner will receive a telephone/WhatsApp call or message/SMS from a representative of the Agency.
6.3. The Agency shall require Potential Prize Winners to submit copies of a valid National Identification Card.
6.4. A Potential Prize Winner found not to have complied with the T&Cs, shall automatically be disqualified and the Prize shall be forfeited.
6.5. The Agency will notify Validated Winners of the location, place and time where Prizes can be collected/delivered. In the event a Validated Winner has been notified but fails to redeem their Prize at the Waakye Festival on the aforementioned date, the individual’s right to the Prize will automatically lapse and the Agency shall pick a Replacement Winner.
7. GOVERNING LAW AND DISPUTE RESOLUTION
7.1. The Competition and these T&Cs shall be governed by and interpreted in accordance with the laws of Ghana and where any provision of the T&Cs is adjudged by a court of competent jurisdiction as invalid, it shall not affect the remaining provisions in any way, to the extent possible.
7.2. All disputes, differences and/or claims, arising out of this Competition and the T & Cs shall be resolved amicably in a manner as determined by the Client. The decision of the Client in this respect shall be final and binding on all Participants.
8. VARIATION AND DISQUALIFICATION
8.1. The Agency reserves the right to cancel, amend or vary this Competition and the rules hereof at any time with or without prior notice to the General Public.
8.2 The Agency shall further reserve the right, at its sole discretion to refuse a Prize Winner their Prize upon the said Winner’s involvement in any of the following incidents:
8.2.1. Actual or suspected fraud in relation to the Competition; or Any attempt to disrupt, tamper
with or unfairly influence the Competition, or its operation mechanism.
8.2.2. Breach of any of the terms and conditions herein; and any other misconduct or unacceptable act as may be determined by the Agency and/or the Client.
8.3. In the event a Participant is disqualified, that Participant shall forfeit their Prize. In addition, the Agency and/or the Client shall reserve the right to take appropriate legal action against the said Participant.
